Danish national individual given deferred prison term for posting explicit film clips on the social platform Reddit

A Danish man has been found guilty of uploading sexually explicit segments from copyrighted films and TV series on the online platform Reddit.

Based on a law enforcement report reviewed by BBC News, the unnamed man shared 347 clips of explicit scenes in a Reddit group he moderated, which were then viewed 4.2 million-plus times.

The country's authorities state he has been given a 7-month suspended jail term for copyright infringement.

Legal analysts say the man was charged under a seldom-invoked provision in Denmark's copyright law, with the court ruling that by removing the footage out of their original context, the accused had harmed the artists' "ethical entitlements".

He has additionally been found guilty of sharing more than 25 terabytes of copyrighted digital content.

From spring 2022 to May 2023, the user using the alias "the pseudonym KlammereFyr" on Reddit uploaded adult scenes including over 100 female performers.

He distributed them in the forum he was a administrator of.

According to the Danish copyright protection organization The Rights Alliance (TRA), his subreddit had more than 6,000 subscribers and participants were encouraged to ask for clips of specific performers.

In 2023, advocates reported the case to the police on behalf of the impacted actors, filmmakers and production companies, which led to the subreddit being shut down.

Andrea Vagn Jensen, among the performers whose explicit content were circulated in the community, explained to local media at the period she believed there was a distinction between being seen naked in a movie and appearing on Reddit.

The actress stated the posts constituted "abuse".

The defendant was arrested in fall 2024 and pleaded culpable to the allegations last month.

In a comment after the verdict, the head of the Rights Alliance Maria Fredenslund remarked the decision sent an "important" signal "that infringements of creators' rights has repercussions".

The ruling is considered unprecedented in the country for its application of the "moral rights" clause of the national copyright law, which specifies an creator's creation cannot be used in a way which violates their reputation.

Intellectual property specialist a legal scholar informed the media the legal matter was "unusual" for its focus on the damage to the integrity of an artist, rather than to them financially.

The extent to which the case could affect nations abroad is unclear.

But she said there may be "more and more of these actions" in the future with the growth of artificial intelligence, where "the sanctity of an individual's creative output might be compromised much more easily".
